NOTICE OF PUBLIC MEETING
NOTIFICACIÓN DE REUNIÓN PÚBLICA

SEPTEMBER 9, 2020

NOTICE is hereby given that the Board of Directors of Montgomery County Municipal Utility District No. 8 (the “District”) of Montgomery County, Texas will meet in regular session, open to the public, on WEDNESDAY, SEPTEMBER 9, 2020, at 9:00 A.M, via video and telephone conference call pursuant to Texas Government Code, Section 551.125, as amended, and as modified by the temporary suspension of various provisions thereof effective March 16, 2020, by the Governor of Texas in accordance with the Texas Disaster Act of 1975, all as related to the Governor’s proclamation on March 13, 2020, certifying that the COVID-19 pandemic poses an imminent threat of disaster and declaring a state of disaster for all counties in Texas. All members of the public may participate in the meeting via video conference or telephone conference call, at which meeting the following items will be discussed:

1. Consideration of public comments (public comment shall be limited to 3 minutes per member of the public);

2. Approve minutes of August 12, 2020 regular meeting;

3. Tax Assessor/Collector’s Report, including:
a. review of collection report;
b. review Delinquent Tax Report, including recommendations for termination of water and sewer service to delinquent taxpayers;
c. update on notices regarding termination of delinquent tax accounts; and
d. set public hearing for termination of delinquent tax accounts;

4. 2020 Tax Rate, including:
a. conduct Public Hearing on Tax Rate (members of the public will be granted an opportunity to provide comments related to the 2020 tax rate);
b. adopt Order Setting Rate and Levying Tax for 2020;
c. adopt Order Appointing Tax Assessor/Collector;
d. approve Amended and Restated District Information Form; and
e. adopt Resolution Concerning Tax Collection Procedures;

5. Bookkeeper’s Report, including:
a. review and approve financial reports;
b. review cash flows;
c. authorize payment of bills;
d. authorize distribution of draft wastewater treatment plant facilities’ budget to Montgomery County Municipal Utility District No. 9 (“MUD 9”) for fiscal year ending December 31, 2021; and
e. discuss engagement of Mark Burton to prepare District financial statements to comply with SAS 115 requirements;

6. Engineer’s Report, including:
a. status of Wastewater Treatment Plant Improvement Project, including approval of easement to Entergy;
b. status of design of Drainage Improvements Project, Phase II;
c. status of Hydropneumatic Tank No. 1 Replacement at Water Plant No. 1;
d. status of Buckingham Water Plant Improvements Project; and
e. discuss Risk and Resilience Assessment required by Environmental Protection Agency;

7. Operator’s Report, including:
a. review monthly water and wastewater operations, including discuss options for removal of large solids (rags);
b. report on delinquent accounts and discuss suspension of service terminations;
c. review Catahoula operations;
d. review Ground Water Reduction Plan Monthly Operations Report; and
e. status of valve location project;

8. Miscellaneous Reports, including updates on:
a. Walden Community Improvement Association (“WCIA”);
b. MUD 9 meetings; and
c. Lone Star Groundwater Conservation District meetings;

9. Update on District’s website and communications services;

10. Update on incentives to increase use of e-statements billing, including service fees for statement billing and take any necessary actions on same;

11. Authorize attendance at AWBD Fall Seminar and Mid-Winter Conference; review attendance by Directors and reimbursement of expenses;

12. Attorney’s Report, including:
a. update on agreement with MUD 9 for financing, construction and operation of drainage improvements and take any necessary actions on same;
b. update on matters related to the District’s Groundwater Reduction Plan Facilities;
c. update on status of conveyance of property to WCIA; and
d. update on insurance claims for damages related to wastewater backflow and take any necessary actions on same; and

13. Executive Session, as necessary;
a. as may be permitted by Sec. 551.072, Texas Gov’t Code, concerning real estate, security, litigation, or matters involving attorney-client privilege;
b. reconvene in Open Session; and
c. vote on matters discussed in Executive Session, if any.
